General & Special Terms for the Provision of Hosting, Website Development, & Digital Services of the EDvision Agency

Legally Binding Terms

1. Introduction

These General and Special Terms for the Provision of Hosting Services govern the legal relationship between ED – Vision (hereinafter referred to as the Service Provider) and the service user.

These General Terms of Use shall enter into force on April 12, 2021, and shall remain valid until changed. We may update or amend these terms from time to time to comply with the law or to adapt to changing business requirements.

2. Pricing & Payment Terms

The price list of all services provided by the Service Provider is publicly available at: https://ed-vision.com/en/domain-and-hosting-services/

ED-Vision is authorized to change the price list, of which it will notify users by publishing updates on its website or through another suitable manner.

For existing users, the amended price will apply after a period of 30 days from the date of publication of those changes on the official website of Ed-Vision or in another suitable manner.

The Client agrees to pay for all services by the applicable due date. If an invoice remains unpaid after its due date, ED-Vision reserves the right to charge statutory default interest on the outstanding amount, as well as any costs associated with issuing payment reminders. Furthermore, ED-Vision may suspend the service to prevent any additional damage or financial loss resulting from continued use.

Payment Due Date

If the Client fails to settle their financial obligations to ED-Vision within 30 days from the date of the pro forma invoice or invoice, and following a written payment reminder, ED-Vision reserves the right to immediately terminate the service agreement without further written notice and to initiate legal proceedings for the recovery of the outstanding debt.

3. Accuracy of Data

The Service Provider reserves the right to reject a request for the provision of services in the following cases:

  • If there is reasonable suspicion that the information provided regarding the Client’s identity, legal capacity, authorization, or right of representation is inaccurate, misleading, or false.
  • If there is reasonable suspicion that the Client intends to misuse the services or allow a third party to misuse them.

The Service Provider reserves the right to send the Client informational communications by email or in writing regarding its own services and matters directly related to the use of those services.

The Client is required to notify the Service Provider by email or in writing of any changes to their personal or contact information no later than seven (7) days after such changes occur. Failure to do so will result in all communications being deemed validly delivered using the existing contact information on record.

4. Communication

5. Confidential Data

ED-Vision respects the privacy of its clients and uses only the information provided by clients during mutual communication. Certain personal data may be required for the registration of hosting services and domain names and will be used exclusively for these purposes.

We will use personal data to respond to individual requests for information and to better understand our clients’ needs in order to continuously improve our products and services. In this regard, we may use this information to communicate with clients when necessary. We will not sell, misuse, or disclose personal data to any third party without the client’s consent.

6. Backup & Security Copies of Web Space

ED-Vision provides each client with the option to independently create backups through the web hosting administration panel (cPanel). Users can generate complete backups of their hosting space, email accounts, MySQL databases, statistics, and other related data. Each client is responsible for creating and storing their own backups and may save them locally on their computer or on external storage media such as a CD or DVD.

Data Liability Disclaimer

ED-Vision cannot be held responsible for any loss of data stored within the Client’s web hosting space. Therefore, it is essential that clients regularly create and maintain their own local backup copies. Backup copies provided by the Service Provider are intended as a convenience service and do not replace the Client’s own backup procedures. The Client remains fully responsible for ensuring that all important data is securely backed up and available when needed.

If the Service Provider determines that another service provider would better meet the Client’s needs, it reserves the right to terminate the hosting agreement at its sole discretion. Where reasonably possible, the Service Provider will provide a 30-day notice period prior to termination and will provide a backup copy of the complete website content and email data.

7. Use of Hosting for Legal Purposes

ED-Vision is committed to providing access to the subscribed services in the best possible manner. All services provided by ED-Vision may only be used for lawful purposes. By purchasing web hosting, internet domain services, or any other services provided by ED-Vision, the Client agrees to comply with all applicable rules, terms, and conditions of use and assumes full responsibility for the proper and lawful use of the subscribed services.

ED-Vision is not obligated to monitor or control the content published by the Client on their domain or web hosting space.

Client Responsibilities

The Client is solely responsible for all content stored, published, or displayed within their web hosting space and is liable for any damage or consequences resulting from its use, publication, or presentation on the internet through their web space and domain. This includes:

  • Publishing or transmitting information that directly violates applicable local and/or international laws.
  • Publishing or transmitting information that is known or reasonably suspected to be false and may cause harm to other individuals through its use.
  • Sending or transmitting advertising or promotional materials to other internet users without their consent or request (SPAM).
  • Publishing, transmitting, or distributing content protected by applicable laws.
  • Obtaining or publishing confidential or protected information belonging to an individual, company, service provider, or other legal entity.
  • Publishing, sending, or transmitting offensive, threatening, vulgar, racist, or discriminatory content.
  • Impersonating another individual or legal entity, including the unauthorized use of another person’s user account or email address.
  • Publishing, sending, or transmitting content that promotes services or products in the form of chain letters.
  • Any actions that may directly or indirectly compromise the security, availability, or uninterrupted operation of other users’ services or the proper functioning of the provided services.
  • Publishing adult content, including pornography and other inappropriate material, on the hosting space provided by ED-Vision.
  • Publishing pirated or otherwise illegal content on space leased from ED-Vision, including but not limited to cracking, hacking, phishing, phreaking, as well as providing links to such content.

ED-Vision is under no obligation to monitor or review content uploaded by users to space leased from ED-Vision. ED-Vision reserves the right to suspend or terminate a user’s access to any service if it determines that the service is being used inappropriately. ED-Vision also reserves the right to seek reimbursement for any costs incurred as a result of the User’s unacceptable or unauthorized use of the services.

8. Transparency of Information

The User is required to provide full access to their web space where necessary in connection with legal proceedings, prosecution, or an investigation conducted against the User.

ED-Vision has no grounds for disclosing or providing access credentials to any third party, as the User has full administrative rights to manage their domain and the complete administration of their web space. In the event of an investigation conducted by authorized domestic or foreign government authorities, legal proceedings, or a lawsuit, and pursuant to an official court order or police investigation, ED-Vision may provide access to information relating to the User’s account, the initial order quotation, and the official invoice issued to the User.

9. Service Unavailability Due to Force Majeure

The User acknowledges and agrees that ED-Vision’s services may not be available at all times and that ED-Vision shall not be held liable for any resulting loss or damage. The Internet is a global computer network that is beyond ED-Vision’s control and to which ED-Vision is merely connected. Therefore, ED-Vision cannot guarantee the availability of services that are not under its direct control.

The User agrees and acknowledges that ED-Vision shall not be held liable for any interruption of services arising directly or indirectly from:

  • Interruptions in the transmission of data to or from the Internet.
  • Actions or interruptions of services provided by third parties.
  • Factors beyond our reasonable control.
  • Any acts or omissions by the User.
  • Problems with the User's equipment and/or third-party equipment.

Ed-Vision will not be liable for any potential damages or loss of profit arising during necessary system maintenance that might affect the service quality of ED-Vision. ED-Vision assumes no liability for any damage that may arise from the temporary or permanent termination of the user relationship due to non-payment of overdue invoices or breach of terms.

10. Prohibition of Web Hosting Service Resale

Hosting packages are exclusively for use by the user. Users of hosting packages are not authorized to resell the leased package, nor provide hosting services to third parties on the leased space, unless they enter into such an agreement with ED-Vision.

Severe violation of the rules results in termination of service without notice. ED-Vision is not liable for any potential damages or claims for compensation that may arise from the user's failure to comply with these rules. The user undertakes to reimburse ED-Vision for any potential third-party costs arising from improper use of the services.

11. Service Expiration Notices, Suspension, and Deletion

ED-Vision will notify the User 30 days prior to service expiration via email, SMS, or another method regarding the expiration, and will send the user a proforma invoice for the service renewal.

In the event that the payment is completed, you will receive the original invoice by mail.

In the event of a severe violation of the rules, ED-Vision reserves the right to deactivate the service without prior warning.

The Client is obligated to submit to ED-Vision any change in personal data (name, address, phone). ED-Vision is not responsible if you do not receive a warning, proforma invoice, or invoice due to incorrect details.

12. Client Conduct

Under no circumstances will we tolerate threatening or abusive behavior toward ED-Vision employees. If this occurs, we reserve the right to immediately terminate the hosting agreement.

If, during a telephone conversation, email, or any other method of communication, a client announces the initiation of legal action against ED-Vision or states anything from which it could be concluded that the user may intend to bring a legal claim against us, we reserve the right to refuse telephone support. Any further correspondence must then be conducted via email.
