General and Special Terms and Conditions for Hosting Services
Introduction
These General and Special Terms and Conditions for Hosting Services govern the legal relationship between ED – Vision (hereinafter referred to as the Service Provider) and the service user. The General Terms of Use came into force on April 12, 2021, and remain valid until amended. We may update or modify these terms from time to time to comply with the law or to adapt to changing business requirements.
Pricing and Payment Terms
The price list for all services provided by the Service Provider is publicly available at the following address: https://ed-vision.com/web-hosting.
ED-Vision is authorized to change the price list, of which it will notify users by posting on its website or in another appropriate manner.
For existing users, the amended price will apply after a period of 30 days from the date of publication of these changes on the official Ed-Vision website or in another appropriate manner.
The user undertakes to pay for the services by the due date. In the event that the invoice is not settled by the due date, ED-Vision is authorized to charge statutory default interest on overdue and unpaid claims, as well as the costs of sending reminders, and has the right to deactivate the service to prevent the client from causing further damage.
If the service user does not settle their obligations to ED-Vision within 30 days from the date of issuance of the pro-forma invoice/invoice, and following a written reminder, Ed-Vision may, without additional written warning, immediately terminate the user relationship and initiate judicial collection proceedings.
Accuracy of Data
The Service Provider has the right to refuse a request for the provision of services: a) if there is a reasonable suspicion that the data regarding the identity or legal capacity of the User, or deficiencies in authorization or representation rights, are inaccurate or untrue, b) if there is a reasonable suspicion that the User intends to abuse the services or enable a third party to abuse the services.
The Service Provider has the right to distribute informative messages to the User via email or in writing, solely regarding its services and information related to the use of those services.
The User is obliged to notify the Service Provider via email or in writing of any change in personal/contact data no later than 7 days after the change occurs; otherwise, it will be considered that delivery has been validly executed based on the existing data.
Communication
The User can contact the Service Provider via the official email info〈@〉ed-vision.com. Every email will receive a response within 12 hours. In case of an urgent intervention, you can contact us at +387 62 129 740.
Confidential Data
ED-Vision respects the privacy of its clients and will only use the data provided by the client during mutual communication. Some of these private data points are essential for the registration of hosting and domains and will be used for those purposes. We will use private data to fulfill individual requests for information and will rely on this data to better understand user needs in order to improve our products and services. In this regard, we may use this information to contact users. We will not sell or use this data, nor will we transfer this data to a third party without the user’s consent.
Backup, Website Security Copies
ED-Vision provides an option within every control panel (cPanel) for the independent creation of security copies of the user’s web hosting space, emails, MySQL databases, statistics, etc. Every user can independently create a full backup of their web space and store it locally on their computer or CD/DVD.
ED-Vision cannot be held responsible for the loss of data within the user’s web space; therefore, it is very important for the user to independently and regularly create their own local backup copies. The Service Provider’s security copies are intended as a practical service and are not a substitute for the user’s own backups. It is the user’s responsibility to ensure a backup of all their important data.
If the Service Provider believes that another service provider would better meet the user’s needs, it reserves the right, at its own discretion, to terminate the hosting agreement. If reasonable, it will provide a 30-day notice of termination and provide a backup of the entire website content and email.
Use of Hosting for Legal Purposes
ED-Vision undertakes to enable the use of leased services in the best possible way. All services leased from ED-Vision may be used only for legal purposes. By leasing web space and an internet domain—i.e., the services of ED-Vision—it is understood that the user will comply with all stated rules and terms of use and fully assumes responsibility when using the leased services.
ED-Vision is not obliged to monitor or control the content that the user publishes on their domain and web space. The user is solely responsible for all content located and published within their web space and is responsible for any damage that may arise from its use, publication, or display on the internet through the web space and domain. This refers to:
Publishing or transmitting information that directly violates existing local and/or international laws.
Publishing or transmitting information known or assumed to be false, the use of which could cause harm to others.
Sending or transmitting advertising or promotional materials to other internet users without their consent or request (SPAM).
Publishing, transmitting, or sending content protected by law.
Obtaining or publishing secret or protected data of an individual, company, service, or other legal entity.
Publishing, sending, or transmitting offensive, threatening, vulgar, racist, or chauvinistic content.
Misrepresentation, i.e., representing oneself on behalf of another legal or natural person.
Unauthorized use of someone else’s user account or email address.
Publishing, sending, or transmitting content offering services or products in the form of chain letters.
Any acts that directly or indirectly jeopardize the security or undisturbed operation of other users or the functioning of services.
Publishing adult content, including pornography and other inappropriate content, on space leased from ED-Vision.
Publishing pirated and other illegal content on space leased from ED-Vision, including but not limited to: cracking, hacking, phishing, phreaking, as well as providing links to such content.
ED-Vision has no obligation to control or check the content that users post on the space leased from ED-Vision. ED-Vision reserves the right to disable or terminate user access to any service if it assesses that the service is not being used appropriately and reserves the right to seek compensation for costs caused by the User’s unacceptable or prohibited use of the services.
Information Transparency
The User is obliged to allow full access to their web space if required in a legal dispute, prosecution, or investigation conducted against the user. ED-Vision has no basis for handing over or providing access data to a third party because the user holds full administrative rights to manage their domain and the complete administration of their web space. In the event of an investigation by authorized domestic or foreign state institutions, a legal dispute, or a lawsuit, and based on an official court order or police investigation, ED-Vision may provide access to information regarding the user account, the initial order offer, and the official invoice issued to the User.
Service Unavailability Due to "Force Majeure"
The User agrees that there is a possibility that Ed-Vision’s services will not always be available and that Ed-Vision is not liable for any resulting damages. The Internet is an international computer network that ED-Vision cannot control but is merely connected to; therefore, it cannot guarantee the availability of services that are not under the direct control of ED-Vision.
The User agrees and confirms they understand that ED-Vision will not be held responsible for any service interruptions resulting directly or indirectly from:
Interruptions in data flow to or from the Internet.
Activities or service interruptions provided by a third party.
Factors beyond our reasonable control.
Any actions or omissions by the User.
Problems with the User’s equipment and/or third-party equipment.
Ed-Vision will not be liable for any potential damages or lost profits arising during necessary system maintenance that might affect the quality of Ed-Vision’s service.
ED-Vision assumes no responsibility for damages that may arise from the temporary or permanent termination of the user relationship due to non-payment of overdue invoices or violation of terms.
Prohibition of Resale of Web Hosting Services
Hosting packages are exclusively for use by the User. Users of hosting packages are not authorized to resell the leased package, nor to provide hosting services to third parties on the leased space, unless they enter into such an agreement with ED-Vision.
A gross violation of these rules will result in the termination of service without notice. ED-Vision is not responsible for any potential damages or claims for compensation that may arise from the User’s failure to comply with these rules. The User undertakes to reimburse ED-Vision for any potential costs toward third parties resulting from the improper use of services.
Warnings Before Service Expiration, Suspension, and Deletion
ED-Vision will notify the User 30 days before the expiration of the service via email, SMS, or another appropriate method regarding the upcoming expiration and will send the User a pro-forma invoice for the service renewal. Once the payment is processed, you will receive the original invoice by mail.
In the event of a gross violation of the rules, ED-Vision reserves the right to deactivate the service without prior warning.
The client is obliged to provide ED-Vision with any changes to personal data (name, address, telephone). ED-Vision is not responsible if you do not receive a warning, pro-forma invoice, or invoice due to incorrect data.
Client Behavior
Under no circumstances will we tolerate threatening or abusive behavior toward ED-Vision employees. If this occurs, we reserve the right to terminate the hosting agreement immediately.
If a client, during a telephone conversation, email, or any other form of communication, announces the initiation of legal action against ED-Vision or says anything that could lead to the conclusion that the user may intend to launch a legal claim against us, we reserve the right to refuse telephone support. All further correspondence must then be conducted via email.
